Narrative:
Assigned loupe 9 departure with clearance to maintain 5000 ft, expect request standard altitude 10 mins after departure. Captain flying. SID requires crossing sjc 047 degree radial at or below 5000 ft then expect vector to sjc VOR, cross sjc VOR at or above 12000 ft. I contacted departure after liftoff before turn to 120 degrees. Passing 3000 ft, aircraft was cleaned up and accelerated to 250 KTS. We crossed 047 degree radial at 5000 ft. Captain began climb and approach notified us to turn right direct to sjc VOR and asked us what was our altitude clearance. I told him to cross VOR at or above 12000 ft. He said ok, climb to 14000 ft. Later, I brought up to captain that we had not been verbally cleared up higher than 5000 ft and that was our printed clearance even though SID depicted 047 degree radial at or below 5000 ft then VOR at or above 12000 ft. We are both submitting NASA reports. SID could be clarified with note to maintain 5000 ft until cleared for further climb (next to note about expect vector to sjc VOR).
Original NASA ASRS Text
Title: ALTDEV BY A DC10 CARGO FLC WHEN THE PIC LEAVES HIS ASSIGNED ALT OF 5000 FT FOR 12000 FT PRIOR TO GETTING CLRNC FOR A TURN DIRECT TO THE VOR AT SJC, CA.
Narrative: ASSIGNED LOUPE 9 DEP WITH CLRNC TO MAINTAIN 5000 FT, EXPECT REQUEST STANDARD ALT 10 MINS AFTER DEP. CAPT FLYING. SID REQUIRES XING SJC 047 DEG RADIAL AT OR BELOW 5000 FT THEN EXPECT VECTOR TO SJC VOR, CROSS SJC VOR AT OR ABOVE 12000 FT. I CONTACTED DEP AFTER LIFTOFF BEFORE TURN TO 120 DEGS. PASSING 3000 FT, ACFT WAS CLEANED UP AND ACCELERATED TO 250 KTS. WE CROSSED 047 DEG RADIAL AT 5000 FT. CAPT BEGAN CLB AND APCH NOTIFIED US TO TURN R DIRECT TO SJC VOR AND ASKED US WHAT WAS OUR ALT CLRNC. I TOLD HIM TO CROSS VOR AT OR ABOVE 12000 FT. HE SAID OK, CLB TO 14000 FT. LATER, I BROUGHT UP TO CAPT THAT WE HAD NOT BEEN VERBALLY CLRED UP HIGHER THAN 5000 FT AND THAT WAS OUR PRINTED CLRNC EVEN THOUGH SID DEPICTED 047 DEG RADIAL AT OR BELOW 5000 FT THEN VOR AT OR ABOVE 12000 FT. WE ARE BOTH SUBMITTING NASA RPTS. SID COULD BE CLARIFIED WITH NOTE TO MAINTAIN 5000 FT UNTIL CLRED FOR FURTHER CLB (NEXT TO NOTE ABOUT EXPECT VECTOR TO SJC VOR).
