Narrative:

While proceeding sbound on A523, FL330, preparing to call sju center, TCASII issued a TA. 2 aircraft were observed northbound, apparently on A523. One 3000 ft above the other, an MD11 at FL330. Both aircraft were visually sighted, and it was observed that the MD11 deviated right of course to avoid us. No maneuver was necessary on our part, nor was a RA given by TCASII. Our closest distance to the MD11 was approximately 5 mi. We contacted sju center and asked for an explanation. We were given a phone number to call on arrival. I did this and was told that the event was being investigated that it was deemed controller error. In flight, MD11 also indicated it would file a report.

Title: A300 FLT CREW RECEIVES A TCASII TA WHILE ENRTE.

Narrative: WHILE PROCEEDING SBOUND ON A523, FL330, PREPARING TO CALL SJU CTR, TCASII ISSUED A TA. 2 ACFT WERE OBSERVED NBOUND, APPARENTLY ON A523. ONE 3000 FT ABOVE THE OTHER, AN MD11 AT FL330. BOTH ACFT WERE VISUALLY SIGHTED, AND IT WAS OBSERVED THAT THE MD11 DEVIATED R OF COURSE TO AVOID US. NO MANEUVER WAS NECESSARY ON OUR PART, NOR WAS A RA GIVEN BY TCASII. OUR CLOSEST DISTANCE TO THE MD11 WAS APPROX 5 MI. WE CONTACTED SJU CTR AND ASKED FOR AN EXPLANATION. WE WERE GIVEN A PHONE NUMBER TO CALL ON ARR. I DID THIS AND WAS TOLD THAT THE EVENT WAS BEING INVESTIGATED THAT IT WAS DEEMED CTLR ERROR. IN FLT, MD11 ALSO INDICATED IT WOULD FILE A RPT.
