Narrative:
The maspeth climb says, 'turn right, maintain heading 180 degrees until leaving 3000 ft, then turn right to 340 degrees.' on initial contact with departure control, ATC informed us that the preceding air carrier Y aircraft was NORDO, therefore, climb only to 3000 ft. Upon reaching 3000 ft, the captain asked me if we were cleared right to heading 340 degrees. I responded that according to the maspeth climb, we were only cleared to heading 340 degrees leaving 3000 ft. Within 2-3 seconds, ATC asked, 'are you in the turn to 340 degrees? You are in kennedy airspace.' I replied, 'we are not cleared to 340 degrees until leaving 3000 ft.' ATC instructed us to turn to heading 310 degrees, and we complied. Supplemental information from acn 618990: maybe controller should have said 'maintain 3000 ft, turn right 340 degrees upon reaching 3000 ft.'
Original NASA ASRS Text
Title: UNCOORD ENTRY INTO NEIGHBORING JFK CLASS B AIRSPACE BY A DEP B737 WHEN SID WAS ALTERED BY N90 DEP CTLR WITH AN ALT CHANGE THAT CONFUSED THE CREW AS TO WHEN TO MAKE THE TURN TO THE NW OUT OF LGA, NY.
Narrative: THE MASPETH CLB SAYS, 'TURN R, MAINTAIN HDG 180 DEGS UNTIL LEAVING 3000 FT, THEN TURN R TO 340 DEGS.' ON INITIAL CONTACT WITH DEP CTL, ATC INFORMED US THAT THE PRECEDING ACR Y ACFT WAS NORDO, THEREFORE, CLB ONLY TO 3000 FT. UPON REACHING 3000 FT, THE CAPT ASKED ME IF WE WERE CLRED R TO HDG 340 DEGS. I RESPONDED THAT ACCORDING TO THE MASPETH CLB, WE WERE ONLY CLRED TO HDG 340 DEGS LEAVING 3000 FT. WITHIN 2-3 SECONDS, ATC ASKED, 'ARE YOU IN THE TURN TO 340 DEGS? YOU ARE IN KENNEDY AIRSPACE.' I REPLIED, 'WE ARE NOT CLRED TO 340 DEGS UNTIL LEAVING 3000 FT.' ATC INSTRUCTED US TO TURN TO HDG 310 DEGS, AND WE COMPLIED. SUPPLEMENTAL INFO FROM ACN 618990: MAYBE CTLR SHOULD HAVE SAID 'MAINTAIN 3000 FT, TURN R 340 DEGS UPON REACHING 3000 FT.'
