Narrative:
A broken/missing tie-down lock for the 9G net was missing. Maintenance wrote it up in the maintenance log as a deferred item in order to launch the aircraft. This is a downing discrepancy according to engineering. This item is on the preflight checklist and was missed by the flight crew because it was written up as a deferred item in the maintenance log. The fitting was broken and incorrectly placed on the deferred item list. Air carrier flight standards did not believe this item was on the aircraft preflight checklist, and it is not part of the training. We suggest making this preflight item stand out during training. Flight was uneventful. Supplemental information from acn 626072: company wrote me 2 days after flight that we had flown an illegally released aircraft. As captain, I was not aware this was a downing gripe unless maintenance told me.

Title: WDB CARGO ACFT IS DISPATCHED WITH IMPROPERLY SECURED CARGO RESTRAINT NET INCORRECTLY DEFERRED BY MAINT.
Narrative: A BROKEN/MISSING TIE-DOWN LOCK FOR THE 9G NET WAS MISSING. MAINT WROTE IT UP IN THE MAINT LOG AS A DEFERRED ITEM IN ORDER TO LAUNCH THE ACFT. THIS IS A DOWNING DISCREPANCY ACCORDING TO ENGINEERING. THIS ITEM IS ON THE PREFLT CHKLIST AND WAS MISSED BY THE FLT CREW BECAUSE IT WAS WRITTEN UP AS A DEFERRED ITEM IN THE MAINT LOG. THE FITTING WAS BROKEN AND INCORRECTLY PLACED ON THE DEFERRED ITEM LIST. ACR FLT STANDARDS DID NOT BELIEVE THIS ITEM WAS ON THE ACFT PREFLT CHKLIST, AND IT IS NOT PART OF THE TRAINING. WE SUGGEST MAKING THIS PREFLT ITEM STAND OUT DURING TRAINING. FLT WAS UNEVENTFUL. SUPPLEMENTAL INFO FROM ACN 626072: COMPANY WROTE ME 2 DAYS AFTER FLT THAT WE HAD FLOWN AN ILLEGALLY RELEASED ACFT. AS CAPT, I WAS NOT AWARE THIS WAS A DOWNING GRIPE UNLESS MAINT TOLD ME.
