Narrative:
We reported in to ZAB 'level at FL330, request 350.' we were eastbound at time of report. ZAB replied, 'do you mean to request 370?' we replied, 'yes, request 370.' ZAB replied, 'maintain 350, expect clearance to 370 shortly.' we replied, 'roger, climbing to 350, we'll expect clearance to 370 later.' in the climb, ZAB said 'I see you're climbing. Maintain 350, I did not clear you to climb.' we replied, 'roger, we will level at 350. We understood that you cleared us to 350.' ZAB replied, 'don't worry about it, just level at 350.' we did and were subsequently cleared to 370. What really caused the problem: center misspoke in saying 'maintain 350' and did not correct us when we reported 'climbing' out of 330 to 350.
Original NASA ASRS Text
Title: A B767 FLT LEVELED AT FL330 AND REQUESTED CLRNC TO '350' WITH '370' LATER. WHILE IN THE CLB TO FL350 THE CTLR ADVISED THE CREW HE DID NOT ISSUE A CLRNC TO FL350.
Narrative: WE RPTED IN TO ZAB 'LEVEL AT FL330, REQUEST 350.' WE WERE EBOUND AT TIME OF RPT. ZAB REPLIED, 'DO YOU MEAN TO REQUEST 370?' WE REPLIED, 'YES, REQUEST 370.' ZAB REPLIED, 'MAINTAIN 350, EXPECT CLRNC TO 370 SHORTLY.' WE REPLIED, 'ROGER, CLBING TO 350, WE'LL EXPECT CLRNC TO 370 LATER.' IN THE CLB, ZAB SAID 'I SEE YOU'RE CLBING. MAINTAIN 350, I DID NOT CLR YOU TO CLB.' WE REPLIED, 'ROGER, WE WILL LEVEL AT 350. WE UNDERSTOOD THAT YOU CLRED US TO 350.' ZAB REPLIED, 'DON'T WORRY ABOUT IT, JUST LEVEL AT 350.' WE DID AND WERE SUBSEQUENTLY CLRED TO 370. WHAT REALLY CAUSED THE PROB: CTR MISSPOKE IN SAYING 'MAINTAIN 350' AND DID NOT CORRECT US WHEN WE RPTED 'CLBING' OUT OF 330 TO 350.
