Narrative:

Deicing fluid applied and was unable to depart due to going below minimum takeoff fuel. Did not have an operable APU. Was directed to go to the northeast hold pad to have the aircraft washed off before returning to the gate for additional fuel. Northeast hold pad did not have water to wash off the aircraft. Was directed to go to spot X for what I assumed was to wash off the aircraft. Dispatch had asked us to hot pit refuel; but we declined because there were no procedures to hot pit refuel. Received a message from dispatch at XA21 confirming we would return to the gate to refuel. At XA30; a refueling truck pulled up and started refueling us without any communications while the main door was closed and both engines were operating. We only knew due to an EICAS message. Attempted to have the fueling stopped; but was unsuccessful. Notified operations and dispatch of the incident. Dispatch advised we could continue.

Title: E145 FLT CREW IS UNABLE TO COM WITH FUELERS TO INSURE COMPLIANCE WHEN FUELING WITH PAX ON BOARD REGS.

Narrative: DEICING FLUID APPLIED AND WAS UNABLE TO DEPART DUE TO GOING BELOW MINIMUM TKOF FUEL. DID NOT HAVE AN OPERABLE APU. WAS DIRECTED TO GO TO THE NE HOLD PAD TO HAVE THE ACFT WASHED OFF BEFORE RETURNING TO THE GATE FOR ADDITIONAL FUEL. NE HOLD PAD DID NOT HAVE WATER TO WASH OFF THE ACFT. WAS DIRECTED TO GO TO SPOT X FOR WHAT I ASSUMED WAS TO WASH OFF THE ACFT. DISPATCH HAD ASKED US TO HOT PIT REFUEL; BUT WE DECLINED BECAUSE THERE WERE NO PROCS TO HOT PIT REFUEL. RECEIVED A MESSAGE FROM DISPATCH AT XA21 CONFIRMING WE WOULD RETURN TO THE GATE TO REFUEL. AT XA30; A REFUELING TRUCK PULLED UP AND STARTED REFUELING US WITHOUT ANY COMS WHILE THE MAIN DOOR WAS CLOSED AND BOTH ENGS WERE OPERATING. WE ONLY KNEW DUE TO AN EICAS MESSAGE. ATTEMPTED TO HAVE THE FUELING STOPPED; BUT WAS UNSUCCESSFUL. NOTIFIED OPS AND DISPATCH OF THE INCIDENT. DISPATCH ADVISED WE COULD CONTINUE.
