Narrative:
Approximately 158 NM south of grann at FL360; we asked new york comrdo to climb to FL380. New york cleared as to climb to FL380 and report level at FL380. As we started to climb out of FL360; we got a TA at FL363 approximately. The PF disengaged the autoplt; reduced thrust levers and pushed down on the control column. We ballooned up to an altitude that gave us an RA. After we cleared traffic; we climbed to FL380. ATC advised us to call tjsj. Tjsj asked us who cleared us to FL308; and did we get an RA? Our response was new york comrdo cleared us to FL380; and yes we did.

Narrative: APPROX 158 NM S OF GRANN AT FL360; WE ASKED NEW YORK COMRDO TO CLB TO FL380. NEW YORK CLRED AS TO CLB TO FL380 AND RPT LEVEL AT FL380.
