Narrative:

Reviewed maintenance log prior to flight. Prior write-up (MEL 34-45) was entered on jun/sun/06 for FMS #2. New write-up (MEL 34-46) for FMS #1. Accepted aircraft for flight. Upon review of aml at destination; discovered that MEL 34-45 should have been cleared from aml before leaving. Called contract maintenance to remove MEL from logbook. MEL 34-46 was governing because both FMS units were inoperative and the aircraft should not have been dispatched with both write-ups. MEL 34-45 only applies when 1 FMS unit is inoperative. Reviewed MEL with captain and line check airman sitting in jumpseat. Also discussed issue with moc and dispatch over the telephone before deciding to call contract maintenance to clear the MEL.

Title: EMB145 FLT CREW ACCEPTS AND FLIES AN ACFT WITH AN OPEN NON-FLYABLE MEL.

Narrative: REVIEWED MAINT LOG PRIOR TO FLT. PRIOR WRITE-UP (MEL 34-45) WAS ENTERED ON JUN/SUN/06 FOR FMS #2. NEW WRITE-UP (MEL 34-46) FOR FMS #1. ACCEPTED ACFT FOR FLT. UPON REVIEW OF AML AT DEST; DISCOVERED THAT MEL 34-45 SHOULD HAVE BEEN CLRED FROM AML BEFORE LEAVING. CALLED CONTRACT MAINT TO REMOVE MEL FROM LOGBOOK. MEL 34-46 WAS GOVERNING BECAUSE BOTH FMS UNITS WERE INOP AND THE ACFT SHOULD NOT HAVE BEEN DISPATCHED WITH BOTH WRITE-UPS. MEL 34-45 ONLY APPLIES WHEN 1 FMS UNIT IS INOP. REVIEWED MEL WITH CAPT AND LINE CHK AIRMAN SITTING IN JUMPSEAT. ALSO DISCUSSED ISSUE WITH MOC AND DISPATCH OVER THE TELEPHONE BEFORE DECIDING TO CALL CONTRACT MAINT TO CLR THE MEL.
