Narrative:
98 mi south of champ; at FL360; on B24 northbound; a thunderstorm was in the center of the airway. At XA40Z; we called comrdo requested 5 mi deviation to left of course and climb to FL390. At XA47Z; comrdo informed us that ZAU declined our request. We told comrdo to inform ZNY we were still going to deviation to left of course; we were not going to fly into a thunderstorm. Comrdo ask if we were using captain's emergency authority/authorized. We replied yes and deviated to left of course 10.3 mi; we did not declare an emergency per southeast. At XA51Z; comrdo called and instructed us to descend to FL350 and report level. We complied. At XA56Z comrdo called and informed us ATC cleared us for a 10 mi left of course deviation; however; at this point we were almost back on course and were now 40 mi south of champ at which time we contacted ZNY as previously instructed. ZNY cleared us direct to rbv.

Narrative: 98 MI S OF CHAMP; AT FL360; ON B24 NBOUND; A TSTM WAS IN THE CTR OF THE AIRWAY. AT XA40Z; WE CALLED COMRDO REQUESTED 5 MI DEV TO L OF COURSE AND CLB TO FL390. AT XA47Z; COMRDO INFORMED US THAT ZAU DECLINED OUR REQUEST. WE TOLD COMRDO TO INFORM ZNY WE WERE STILL GOING TO DEV TO L OF COURSE; WE WERE NOT GOING TO FLY INTO A TSTM. COMRDO ASK IF WE WERE USING CAPT'S EMER AUTH. WE REPLIED YES AND DEVIATED TO L OF COURSE 10.3 MI; WE DID NOT DECLARE AN EMER PER SE. AT XA51Z; COMRDO CALLED AND INSTRUCTED US TO DSND TO FL350 AND RPT LEVEL. WE COMPLIED. AT XA56Z COMRDO CALLED AND INFORMED US ATC CLRED US FOR A 10 MI L OF COURSE DEV; HOWEVER; AT THIS POINT WE WERE ALMOST BACK ON COURSE AND WERE NOW 40 MI S OF CHAMP AT WHICH TIME WE CONTACTED ZNY AS PREVIOUSLY INSTRUCTED.
