Narrative:

We departed runway 24 at teb on the teb 5 departure. We flew runway heading and climbed to 1500 ft. When we turned right to heading 280 degrees; the PF initiated climb to 2000 ft prior to reaching 4.5 DME from teb VOR. The new york departure controller reminded us to review the departure procedure in the future because newark arrs could be above us. There were no TCAS alerts or traffic conflicts. As the captain; I should have been more assertive when performing the published SID even though I was the PNF.

THE NEW YORK DEP CTLR REMINDED US TO REVIEW THE DEP PROC IN THE FUTURE BECAUSE NEWARK ARRS COULD BE ABOVE US. THERE WERE NO TCAS ALERTS OR TFC CONFLICTS. AS THE CAPT; I SHOULD HAVE BEEN MORE ASSERTIVE WHEN PERFORMING THE PUBLISHED SID EVEN THOUGH I WAS THE PNF.
