Narrative:

The SR20 was overflying lse from the southeast. The E135 had departed lse to the southeast. After departure; the E135 was stopped at 5000 ft as the SR20 passed over at 6000 ft. The SR20 reported the E135 in sight. I asked the SR20; 'can you maintain visual separation from the E135?' the SR20 replied; 'yes.' I climbed the E135 through the SR20's altitude; and was later informed that I'd used incorrect phraseology.

Title: ZMP CTLR DESCRIBES LEGAL LOSS OF SEPARATION AT 5100 FT WHEN INCORRECT PHRASEOLOGY WAS USED CLBING ACFT THROUGH OCCUPIED ALT.

Narrative: THE SR20 WAS OVERFLYING LSE FROM THE SE. THE E135 HAD DEPARTED LSE TO THE SE. AFTER DEP; THE E135 WAS STOPPED AT 5000 FT AS THE SR20 PASSED OVER AT 6000 FT. THE SR20 RPTED THE E135 IN SIGHT. I ASKED THE SR20; 'CAN YOU MAINTAIN VISUAL SEPARATION FROM THE E135?' THE SR20 REPLIED; 'YES.' I CLBED THE E135 THROUGH THE SR20'S ALT; AND WAS LATER INFORMED THAT I'D USED INCORRECT PHRASEOLOGY.
