Narrative:

Early morning departure from runway 1 teb. Our clearance was teb 5; radar vectors to parke intersection; on course. Our flight crews fly to this airport often and are familiar with the notorious teb 5 departure. On taxi out the PF gave me a vague and relaxed briefing on the departure procedure and when I corrected him on several of the specifics of the procedure he assured me he understood all restrs on altitudes and headings. He further advised me he would fly the procedure with the flight director coupled to the FMS. For some reason on initial climb out the PF became convinced that the FMS was not flying the procedure correctly and seemed to disregard its guidance. We were to level at 2000 ft but climbing through 1000 ft I noticed we had a rate of climb of over 3000 FPM. At the time I pointed out 1000 ft to leveloff tower handed us off to departure. I made the mistake of thinking that the PF had acknowledged and was leveling the aircraft when in fact he was preoccupied with his course guidance. While I was checking in with departure the aircraft climbed to 2800 ft before I could get the pilot's attention regarding his altitude. Immediately after contacting departure we were issued a climb to 6000 ft and the PF assured me all was now fine. This pilot has a history of problems flying departures and stars and whenever he has an incident seems unable to learn from it but puts it out of his mind and forgets it. In retrospect I feel I should have been more proactive in monitoring the procedure since I knew the PF had a very relaxed attitude about the departure and had previously demonstrated an inability to fly demanding procedures.

Title: CE560 FLT CREW EXCEEDS 2000 FT PRIOR TO PNJ ON THE TEB 5 DEP.

IMMEDIATELY AFTER CONTACTING DEP WE WERE ISSUED A CLB TO 6000 FT AND THE PF ASSURED ME ALL WAS NOW FINE. THIS PLT HAS A HISTORY OF PROBLEMS FLYING DEPS AND STARS AND WHENEVER HE HAS AN INCIDENT SEEMS UNABLE TO LEARN FROM IT BUT PUTS IT OUT OF HIS MIND AND FORGETS IT. IN RETROSPECT I FEEL I SHOULD HAVE BEEN MORE PROACTIVE IN MONITORING THE PROC SINCE I KNEW THE PF HAD A VERY RELAXED ATTITUDE ABOUT THE DEP AND HAD PREVIOUSLY DEMONSTRATED AN INABILITY TO FLY DEMANDING PROCS.
