Narrative:
Pushed back on time for departure runway 13. Aware the lga VOR was OTS a proper departure/flight plan was conducted. In VMC conditions at runway 13. I accepted takeoff clearance from lga ATC and a normal takeoff; uneventful flight was performed. But; due to my oversight during preflight; I was unaware of NOTAM 01-042 (peths NDB OTS). So; while the two engine takeoff procedure was acceptable; the single engine runway 13 procedure could not be done as diagramed under the circumstances. Therefore; I created a violation by accepting the takeoff clearance and departing when only runway 04 or runway 22 were actually legal at that time period. Better awareness regarding NOTAMS and maybe an alert from our dispatch assistants can prevent this error from occurring again.

Title: UNAWARE A NAV FACILITY REQUIRED TO CONDUCT A SPECIAL ENGINE OUT PROC WAS NOTAM'ED OTS; FLT CREW MAKES AN INAPPROPRIATE TKOF FROM LGA RWY 13.
Narrative: PUSHED BACK ON TIME FOR DEP RWY 13. AWARE THE LGA VOR WAS OTS A PROPER DEP/FLT PLAN WAS CONDUCTED. IN VMC CONDITIONS AT RWY 13. I ACCEPTED TKOF CLRNC FROM LGA ATC AND A NORMAL TKOF; UNEVENTFUL FLT WAS PERFORMED. BUT; DUE TO MY OVERSIGHT DURING PREFLT; I WAS UNAWARE OF NOTAM 01-042 (PETHS NDB OTS). SO; WHILE THE TWO ENGINE TAKEOFF PROC WAS ACCEPTABLE; THE SINGLE ENGINE RWY 13 PROC COULD NOT BE DONE AS DIAGRAMED UNDER THE CIRCUMSTANCES. THEREFORE; I CREATED A VIOLATION BY ACCEPTING THE TAKEOFF CLRNC AND DEPARTING WHEN ONLY RWY 04 OR RWY 22 WERE ACTUALLY LEGAL AT THAT TIME PERIOD. BETTER AWARENESS REGARDING NOTAMS AND MAYBE AN ALERT FROM OUR DISPATCH ASSISTANTS CAN PREVENT THIS ERROR FROM OCCURRING AGAIN.
