Narrative:

On departure from runway 24 at teb on the teterboro 5 departure we received a TA on the TCAS just as we were leveling 1500 ft. The flying pilot was hand flying the aircraft and became distracted. The aircraft leveled 80 ft higher than published 1580 ft; the SID calls for 1500 ft before turning to a 280 heading. After the flight we discussed the event and concluded that had the autopilot been engaged; the aircraft; which had the departure SID programmed into the FMS; would have leveled at the appropriate altitude. Also; we should have briefed the possibility of a TCAS TA since aircraft landing ewr overfly teb and the likelihood exists because of the rate of closure of the 2 aircraft.

Narrative: ON DEPARTURE FROM RWY 24 AT TEB ON THE TETERBORO 5 DEPARTURE WE RECEIVED A TA ON THE TCAS JUST AS WE WERE LEVELING 1500 FT. THE FLYING PILOT WAS HAND FLYING THE AIRCRAFT AND BECAME DISTRACTED. THE AIRCRAFT LEVELED 80 FT HIGHER THAN PUBLISHED 1580 FT; THE SID CALLS FOR 1500 FT BEFORE TURNING TO A 280 HEADING. AFTER THE FLIGHT WE DISCUSSED THE EVENT AND CONCLUDED THAT HAD THE AUTOPILOT BEEN ENGAGED; THE AIRCRAFT; WHICH HAD THE DEPARTURE SID PROGRAMMED INTO THE FMS; WOULD HAVE LEVELED AT THE APPROPRIATE ALTITUDE. ALSO; WE SHOULD HAVE BRIEFED THE POSSIBILITY OF A TCAS TA SINCE AIRCRAFT LANDING EWR OVERFLY TEB AND THE LIKELIHOOD EXISTS BECAUSE OF THE RATE OF CLOSURE OF THE 2 AIRCRAFT.
