Narrative:

Our flight had just been cleared to climb out of 10000' to FL220 when ind center called pop up traffic 9 O'clock and 1 mi. When I saw the red and white small aircraft the aircraft was moving 9-8 O'clock and 300' horizontal at our altitude and perpendicular to our flight path. I determined the aircraft would pass below and behind and made no evasive maneuver. I estimate the aircraft passed 100' below and 200' behind ours. Clouds were scattered to broken at fl and hazy. Visibility was about 3-4 mi. ATC, when questioned, said that aircraft had mode C and showed 10700', but had appeared on their screen after we were cleared to climb.

Narrative: OUR FLT HAD JUST BEEN CLRED TO CLB OUT OF 10000' TO FL220 WHEN IND CENTER CALLED POP UP TFC 9 O'CLOCK AND 1 MI. WHEN I SAW THE RED AND WHITE SMA THE ACFT WAS MOVING 9-8 O'CLOCK AND 300' HORIZ AT OUR ALT AND PERPENDICULAR TO OUR FLT PATH. I DETERMINED THE ACFT WOULD PASS BELOW AND BEHIND AND MADE NO EVASIVE MANEUVER. I ESTIMATE THE ACFT PASSED 100' BELOW AND 200' BEHIND OURS. CLOUDS WERE SCATTERED TO BROKEN AT FL AND HAZY. VIS WAS ABOUT 3-4 MI. ATC, WHEN QUESTIONED, SAID THAT ACFT HAD MODE C AND SHOWED 10700', BUT HAD APPEARED ON THEIR SCREEN AFTER WE WERE CLRED TO CLB.
