Narrative:

On departure leg from fll, departure controller assigned an altitude of 16000' and a turn to 300 degree heading to intercept J20. He requested a rapid climb to 16000', and we advised that we would be unable. Due to heavy gross weight and multiple pressurization and pneumatic problems, we could not comply. He then stated that he needed a turn to 270 degrees for traffic since we couldn't rapidly climb. Shortly we approached cumulus cloud buildups and shower activity on our course. We advised the controller that we could not accept a turn to 360 degrees due to WX, and he responded in an irritated voice to maintain 12000' and to request WX deviation heading earlier. We could not understand his irritation when responding, other than the fact that he must have forgotten that he initially assigned the 270 degree heading due to our slow climb and traffic congestion. This poor communication generated concern that we had deviated from an assigned heading and generated a traffic conflict. Supplemental information from acn 111075: it is my belief that amended in flight clrncs in the #1 cause of communication breakdown between pilot and controller. In most cases they involve course intercepts and altitude crossing restrictions.

Title: MISCOM BETWEEN FLT CREW AND ATC. ACFT EQUIPMENT PROBLEM RESULTING IN REDUCED CLIMB PERFORMANCE.

Narrative: ON DEP LEG FROM FLL, DEP CTLR ASSIGNED AN ALT OF 16000' AND A TURN TO 300 DEG HDG TO INTERCEPT J20. HE REQUESTED A RAPID CLB TO 16000', AND WE ADVISED THAT WE WOULD BE UNABLE. DUE TO HEAVY GROSS WT AND MULTIPLE PRESSURIZATION AND PNEUMATIC PROBS, WE COULD NOT COMPLY. HE THEN STATED THAT HE NEEDED A TURN TO 270 DEGS FOR TFC SINCE WE COULDN'T RAPIDLY CLB. SHORTLY WE APCHED CUMULUS CLOUD BUILDUPS AND SHOWER ACTIVITY ON OUR COURSE. WE ADVISED THE CTLR THAT WE COULD NOT ACCEPT A TURN TO 360 DEGS DUE TO WX, AND HE RESPONDED IN AN IRRITATED VOICE TO MAINTAIN 12000' AND TO REQUEST WX DEVIATION HDG EARLIER. WE COULD NOT UNDERSTAND HIS IRRITATION WHEN RESPONDING, OTHER THAN THE FACT THAT HE MUST HAVE FORGOTTEN THAT HE INITIALLY ASSIGNED THE 270 DEG HDG DUE TO OUR SLOW CLB AND TFC CONGESTION. THIS POOR COM GENERATED CONCERN THAT WE HAD DEVIATED FROM AN ASSIGNED HDG AND GENERATED A TFC CONFLICT. SUPPLEMENTAL INFO FROM ACN 111075: IT IS MY BELIEF THAT AMENDED IN FLT CLRNCS IN THE #1 CAUSE OF COM BREAKDOWN BTWN PLT AND CTLR. IN MOST CASES THEY INVOLVE COURSE INTERCEPTS AND ALT XING RESTRICTIONS.
