Narrative:
Small aircraft Y was at 2000' approximately 4 mi southwest of orf. He requested to cross the departure course. I told him to cross 1 mi south of the OM (OM is approximately 3.2 NM from departure end of runway 23). Air carrier X called airborne. He appeared to be climbing slowly. I told small aircraft Y about air carrier X when he was 3 mi away. Air carrier was on an IFR. Small aircraft Y stated that he had air carrier X in sight. I went back and told air carrier X that the other aircraft had him in sight. Air carrier X replied that it was close. Small aircraft Y had air carrier X in sight well before the targets merged (3 mi when I first called traffic out). Air carrier X told the next sector and said that he was going to file a near miss report. After this had happened, I had heard that (air carrier company) had received some sort of waiver for their climb rates. I possibly would have taken another course of action if I had known this. Supplemental information from acn 115678: while climbing out on initial runway heading from orf runway 23, we were advised by ATC of VFR traffic at our 12 O'clock position at 2100' that we were told had us in sight. We either had just been given or shortly after given a turn (right) to 280 degrees. Just as our turn was commencing an small aircraft appeared at our 12 O'clock or slightly left of 12 O'clock position at our altitude and passed to the left of us on an opp heading. I estimate our latitude sep to be 1/4 mi or less.

Title: ACR CONFLICTED WITH AN SMA AFTER DEP.
Narrative: SMA Y WAS AT 2000' APPROX 4 MI SW OF ORF. HE REQUESTED TO CROSS THE DEP COURSE. I TOLD HIM TO CROSS 1 MI S OF THE OM (OM IS APPROX 3.2 NM FROM DEP END OF RWY 23). ACR X CALLED AIRBORNE. HE APPEARED TO BE CLBING SLOWLY. I TOLD SMA Y ABOUT ACR X WHEN HE WAS 3 MI AWAY. ACR WAS ON AN IFR. SMA Y STATED THAT HE HAD ACR X IN SIGHT. I WENT BACK AND TOLD ACR X THAT THE OTHER ACFT HAD HIM IN SIGHT. ACR X REPLIED THAT IT WAS CLOSE. SMA Y HAD ACR X IN SIGHT WELL BEFORE THE TARGETS MERGED (3 MI WHEN I FIRST CALLED TFC OUT). ACR X TOLD THE NEXT SECTOR AND SAID THAT HE WAS GOING TO FILE A NEAR MISS RPT. AFTER THIS HAD HAPPENED, I HAD HEARD THAT (ACR COMPANY) HAD RECEIVED SOME SORT OF WAIVER FOR THEIR CLB RATES. I POSSIBLY WOULD HAVE TAKEN ANOTHER COURSE OF ACTION IF I HAD KNOWN THIS. SUPPLEMENTAL INFO FROM ACN 115678: WHILE CLBING OUT ON INITIAL RWY HDG FROM ORF RWY 23, WE WERE ADVISED BY ATC OF VFR TFC AT OUR 12 O'CLOCK POS AT 2100' THAT WE WERE TOLD HAD US IN SIGHT. WE EITHER HAD JUST BEEN GIVEN OR SHORTLY AFTER GIVEN A TURN (RIGHT) TO 280 DEGS. JUST AS OUR TURN WAS COMMENCING AN SMA APPEARED AT OUR 12 O'CLOCK OR SLIGHTLY LEFT OF 12 O'CLOCK POS AT OUR ALT AND PASSED TO THE LEFT OF US ON AN OPP HDG. I ESTIMATE OUR LAT SEP TO BE 1/4 MI OR LESS.
