Narrative:

While conducting BFR small aircraft X (I as right seat cfia), was cleared for takeoff on runway 20 with left turn out to the local practice area. Left seat private pilot made normal takeoff, extending upwind a few seconds to get 400-500' AGL prior to starting the previously approved left turn. Just as he was about to start left turn, we both spotted a landing light ahead, same altitude, and very slightly (5 degrees?) left of our nose. We held our wings level. In 3 seconds, we could see that it was an small aircraft Y coming at us. The tower then came up and told the small aircraft Y to start his right turn now, and that the small aircraft X (our plane) would be turning opp direction to stay in closed traffic. This was not true, and as the small aircraft Y turned right (east), the tower came on again and said that the small aircraft X actually would be turning east also. The small aircraft Y, by this time, was already turning east, and we did likewise after taking safe interval. The tower had not spoken to us since takeoff with left clearance! He should have positively yelled at us to stay wings level, or even 'turn right immediately.' at no time did he mention opp direction traffic. A phone call to tower later disclosed that the small aircraft Y was on practice VFR ILS approach to runway 02 and failed to comply with instruction to report OM inbound. Actually reported close to MM, surprising the tower controller, who then did not deal adeptly with the conflict, talking to only the small aircraft Y. The controller never asked if we saw the small aircraft Y, and gave us no conflict avoidance help. What saved us? Answer: the small aircraft Y had his taxi light and landing light on!!

Title: PLT OF SMA Y FAILED TO REPORT OUTER MARKER INBOUND ON A PRACTICE ILS APCH. PLT DEVIATION.

Narrative: WHILE CONDUCTING BFR SMA X (I AS RIGHT SEAT CFIA), WAS CLRED FOR TKOF ON RWY 20 WITH LEFT TURN OUT TO THE LCL PRACTICE AREA. LEFT SEAT PVT PLT MADE NORMAL TKOF, EXTENDING UPWIND A FEW SECS TO GET 400-500' AGL PRIOR TO STARTING THE PREVIOUSLY APPROVED LEFT TURN. JUST AS HE WAS ABOUT TO START LEFT TURN, WE BOTH SPOTTED A LNDG LIGHT AHEAD, SAME ALT, AND VERY SLIGHTLY (5 DEGS?) LEFT OF OUR NOSE. WE HELD OUR WINGS LEVEL. IN 3 SECS, WE COULD SEE THAT IT WAS AN SMA Y COMING AT US. THE TWR THEN CAME UP AND TOLD THE SMA Y TO START HIS RIGHT TURN NOW, AND THAT THE SMA X (OUR PLANE) WOULD BE TURNING OPP DIRECTION TO STAY IN CLOSED TFC. THIS WAS NOT TRUE, AND AS THE SMA Y TURNED RIGHT (E), THE TWR CAME ON AGAIN AND SAID THAT THE SMA X ACTUALLY WOULD BE TURNING E ALSO. THE SMA Y, BY THIS TIME, WAS ALREADY TURNING E, AND WE DID LIKEWISE AFTER TAKING SAFE INTERVAL. THE TWR HAD NOT SPOKEN TO US SINCE TKOF WITH LEFT CLRNC! HE SHOULD HAVE POSITIVELY YELLED AT US TO STAY WINGS LEVEL, OR EVEN 'TURN RIGHT IMMEDIATELY.' AT NO TIME DID HE MENTION OPP DIRECTION TFC. A PHONE CALL TO TWR LATER DISCLOSED THAT THE SMA Y WAS ON PRACTICE VFR ILS APCH TO RWY 02 AND FAILED TO COMPLY WITH INSTRUCTION TO RPT OM INBND. ACTUALLY RPTED CLOSE TO MM, SURPRISING THE TWR CTLR, WHO THEN DID NOT DEAL ADEPTLY WITH THE CONFLICT, TALKING TO ONLY THE SMA Y. THE CTLR NEVER ASKED IF WE SAW THE SMA Y, AND GAVE US NO CONFLICT AVOIDANCE HELP. WHAT SAVED US? ANSWER: THE SMA Y HAD HIS TAXI LIGHT AND LNDG LIGHT ON!!
