Narrative:
The copilot copied and read back our ATC clearance which included a full route, followed by 'maintain 12000, expect 290 10 mins after departure.' the departure briefing during the before takeoff checklist included a review of our initial clearance (including climb to 12000'). After a runway 21C routine takeoff, tower instructed to contact departure (copilot flying, me [captain] working radios). Initial contact to departure was '...2400, climbing to 1-2-thousand.' acknowledgement from departure included instructions to turn left to 080 degrees. When climbing through approximately 10800', controller advised us of traffic at 12 O'clock and 11000'. I advised that we were climbing to 12000' (by this time we were already through 11000'). The controller advised an immediate right turn, which we executed and simultaneously saw traffic pass off to our left. Supplemental information from acn 130174: I received a full route clearance and read it back. Departure was metropolitan 7, climb and maintain 12000', expect FL290 10 mins after departure. On taxi-out captain questioned the 12000'. I checked my written clearance that I copied and had read back to clearance.
Original NASA ASRS Text
Title: ACR CLIMBED THROUGH OCCUPIED ALT RESULTING IN LESS THAN STANDARD SEPARATION.
Narrative: THE COPLT COPIED AND READ BACK OUR ATC CLRNC WHICH INCLUDED A FULL ROUTE, FOLLOWED BY 'MAINTAIN 12000, EXPECT 290 10 MINS AFTER DEP.' THE DEP BRIEFING DURING THE BEFORE TKOF CHKLIST INCLUDED A REVIEW OF OUR INITIAL CLRNC (INCLUDING CLB TO 12000'). AFTER A RWY 21C ROUTINE TKOF, TWR INSTRUCTED TO CONTACT DEP (COPLT FLYING, ME [CAPT] WORKING RADIOS). INITIAL CONTACT TO DEP WAS '...2400, CLBING TO 1-2-THOUSAND.' ACKNOWLEDGEMENT FROM DEP INCLUDED INSTRUCTIONS TO TURN LEFT TO 080 DEGS. WHEN CLBING THROUGH APPROX 10800', CTLR ADVISED US OF TFC AT 12 O'CLOCK AND 11000'. I ADVISED THAT WE WERE CLBING TO 12000' (BY THIS TIME WE WERE ALREADY THROUGH 11000'). THE CTLR ADVISED AN IMMEDIATE RIGHT TURN, WHICH WE EXECUTED AND SIMULTANEOUSLY SAW TFC PASS OFF TO OUR LEFT. SUPPLEMENTAL INFO FROM ACN 130174: I RECEIVED A FULL ROUTE CLRNC AND READ IT BACK. DEP WAS METRO 7, CLB AND MAINTAIN 12000', EXPECT FL290 10 MINS AFTER DEP. ON TAXI-OUT CAPT QUESTIONED THE 12000'. I CHKED MY WRITTEN CLRNC THAT I COPIED AND HAD READ BACK TO CLRNC.
