Narrative:
My boss who is supposedly a commercial pilot with an instrument rating was in command of the aircraft on that leg, and I was in the right seat. After takeoff from gmu, he was supposed to level off at 5000', but he didn't till 5200', and then went down to 5000'. We received clearance direct to charleston, sc. After 4 mi from columbia voa, approach control told us to go direct to the VOR, then take the arwy to charleston--so I brought the chart to get the arwy information. After I found the radial outbnd from the VOR, I looked at the altitude and he had gained 400'--so he turned the transponder off and went back down to 5000'. The flight plan was in my name, but he was in command of the aircraft. If I quit my job I will have no means to support my wife and 2 children, since I have already lost my job with air carrier airlines.

Title: CPR SMT ALT DEVIATION EXCURSION FROM CLRNC ALT, THEN PIC TURNED OFF MODE C UNTIL ALT RECOVERED.
Narrative: MY BOSS WHO IS SUPPOSEDLY A COMMERCIAL PLT WITH AN INSTRUMENT RATING WAS IN COMMAND OF THE ACFT ON THAT LEG, AND I WAS IN THE RIGHT SEAT. AFTER TKOF FROM GMU, HE WAS SUPPOSED TO LEVEL OFF AT 5000', BUT HE DIDN'T TILL 5200', AND THEN WENT DOWN TO 5000'. WE RECEIVED CLRNC DIRECT TO CHARLESTON, SC. AFTER 4 MI FROM COLUMBIA VOA, APCH CTL TOLD US TO GO DIRECT TO THE VOR, THEN TAKE THE ARWY TO CHARLESTON--SO I BROUGHT THE CHART TO GET THE ARWY INFO. AFTER I FOUND THE RADIAL OUTBND FROM THE VOR, I LOOKED AT THE ALT AND HE HAD GAINED 400'--SO HE TURNED THE XPONDER OFF AND WENT BACK DOWN TO 5000'. THE FLT PLAN WAS IN MY NAME, BUT HE WAS IN COMMAND OF THE ACFT. IF I QUIT MY JOB I WILL HAVE NO MEANS TO SUPPORT MY WIFE AND 2 CHILDREN, SINCE I HAVE ALREADY LOST MY JOB WITH ACR AIRLINES.
