Narrative:
Downwind departure from sjc continued climb approximately 100' into arsa before level altitude. Departure was to southeast, west of localizer. Tower-sjc-ask for my altitude, prior to which, on crosswind, I heard poor radio transmission from an experimental aircraft entering pattern. Exp crossed under me approximately 25' opposite tower as I turned to southeast from crosswind departure. This distraction of experimental (that apparently crossed VOR for pattern entry from the north) caused my distraction. I continued climb into arsa to 1600' before level flight.
