Narrative:
On a maintenance ferry flight VFR departure from frg, communications problems were experienced after being airborne. Voice communications were lost and an autoplt disrupt caused an attitude pitch up to 3300' MSL, followed by an immediate pilot correction to 2500' MSL. A VFR departure was continued. The flight was planned to depart runway 19 from frg and intercept V483 to avoid the TCA and air traffic area'.south. As a result of communications problems, the aircraft was maneuvered closer to the dpk VOR than desired to establish a positive clearance from the north.Y. TCA. It is possible that passage was made too close to the dpk VOR and the periphery of the long island arsa was entered unintentionally west/O radio communication. As soon as the proximity to the dpk VOR was recognized, a course was taken to maintain clearance from the arsa. V483 was then intercepting and flown at 2500' MSL to maintain TCA avoidance until clear of conflicting airspace. Traffic was encountered on the arwy in the opp direction at a higher altitude. Adequate visibility sep was maintained. It concerned me that communications difficulties prevented confirmation of transponder and mode C function. The transponder and encoder were just checked and certified in the aircraft logs prior to the flight. Cockpit operation was normal. Subsequent flight confirmed normal operation. Most probably, the transponder and mode C were functioning properly on this flight. In the event described, communications problems and the proximity of the TCA created pilot concern for positive TCA avoidance. Possible encroachment into the periphery of the arsa could have been avoid with a more precise departure plan to include more consideration of communications difficulties.

Title: SMT, ON VFR FERRY FLT, EXPERIENCES LOSS OF COM AFTER TKOF AND, IN THE MOMENTARY CONFUSION, PENTRATES NEIGHBORING ARSA.
Narrative: ON A MAINT FERRY FLT VFR DEP FROM FRG, COMS PROBS WERE EXPERIENCED AFTER BEING AIRBORNE. VOICE COMS WERE LOST AND AN AUTOPLT DISRUPT CAUSED AN ATTITUDE PITCH UP TO 3300' MSL, FOLLOWED BY AN IMMEDIATE PLT CORRECTION TO 2500' MSL. A VFR DEP WAS CONTINUED. THE FLT WAS PLANNED TO DEPART RWY 19 FROM FRG AND INTERCEPT V483 TO AVOID THE TCA AND ATA'.S. AS A RESULT OF COMS PROBS, THE ACFT WAS MANEUVERED CLOSER TO THE DPK VOR THAN DESIRED TO ESTABLISH A POSITIVE CLRNC FROM THE N.Y. TCA. IT IS POSSIBLE THAT PASSAGE WAS MADE TOO CLOSE TO THE DPK VOR AND THE PERIPHERY OF THE LONG ISLAND ARSA WAS ENTERED UNINTENTIONALLY W/O RADIO COM. AS SOON AS THE PROX TO THE DPK VOR WAS RECOGNIZED, A COURSE WAS TAKEN TO MAINTAIN CLRNC FROM THE ARSA. V483 WAS THEN INTERCEPTING AND FLOWN AT 2500' MSL TO MAINTAIN TCA AVOIDANCE UNTIL CLR OF CONFLICTING AIRSPACE. TFC WAS ENCOUNTERED ON THE ARWY IN THE OPP DIRECTION AT A HIGHER ALT. ADEQUATE VIS SEP WAS MAINTAINED. IT CONCERNED ME THAT COMS DIFFICULTIES PREVENTED CONFIRMATION OF XPONDER AND MODE C FUNCTION. THE XPONDER AND ENCODER WERE JUST CHKED AND CERTIFIED IN THE ACFT LOGS PRIOR TO THE FLT. COCKPIT OPERATION WAS NORMAL. SUBSEQUENT FLT CONFIRMED NORMAL OPERATION. MOST PROBABLY, THE XPONDER AND MODE C WERE FUNCTIONING PROPERLY ON THIS FLT. IN THE EVENT DESCRIBED, COMS PROBS AND THE PROX OF THE TCA CREATED PLT CONCERN FOR POSITIVE TCA AVOIDANCE. POSSIBLE ENCROACHMENT INTO THE PERIPHERY OF THE ARSA COULD HAVE BEEN AVOID WITH A MORE PRECISE DEP PLAN TO INCLUDE MORE CONSIDERATION OF COMS DIFFICULTIES.
