Narrative:

We were on the westminster 1 arrival to bwi and had just crossed the EMI VOR, descending through 7500', when a tan small transport was observed off our left wing within 300' horizontal and about the same heading. Bwi approach said they had not observed traffic in the area. I called the bwi approach supervisor on the ground and he said there may be a blind spot in the ewi area due to construction at bwi. I filed a verbal near miss to him over the phone. I feel that the small transport should have had a transponder and mode C in that area. Also we were cleared to 4000' almost 30 mi from bwi in a 'blind spot' area.

Title: CLOSE PROX ACR-LGT GA-SAM OVER EMI VOR.

Narrative: WE WERE ON THE WESTMINSTER 1 ARR TO BWI AND HAD JUST CROSSED THE EMI VOR, DSNDING THROUGH 7500', WHEN A TAN SMT WAS OBSERVED OFF OUR LEFT WING WITHIN 300' HORIZ AND ABOUT THE SAME HDG. BWI APCH SAID THEY HAD NOT OBSERVED TFC IN THE AREA. I CALLED THE BWI APCH SUPVR ON THE GND AND HE SAID THERE MAY BE A BLIND SPOT IN THE EWI AREA DUE TO CONSTRUCTION AT BWI. I FILED A VERBAL NEAR MISS TO HIM OVER THE PHONE. I FEEL THAT THE SMT SHOULD HAVE HAD A XPONDER AND MODE C IN THAT AREA. ALSO WE WERE CLRED TO 4000' ALMOST 30 MI FROM BWI IN A 'BLIND SPOT' AREA.
