Narrative:
Air carrier X departure runway 26R with crossing restriction of 14000' at 19 DME of pom 294 degree right (110.4). After copilot called for climb power, the second officer remarked we flew through an inversion layer because the tat gauge went from 25 to 35 degrees somewhere between 2000-5000' MSL. We discussed the tat and decided that we would be unable to meet the 19 DME 14000' restriction. During this period ont departure had switched us from departure 125.5 to ZLA 118.55. I told ZLA we would not be able to make the restriction. We were at approximately 6-8 DME out the 294 degree right below 10000' MSL at this time. We were told to contact ont departure because we were in ont's airspace. (Why were we switched to lax before they had control of us?) I contacted ont departure immediately on 125.5 and told him we would be unable to make the 19 DME 14000' restriction. He said to contact ZLA and tell them. I told him that ZLA said to contact him and again said we wouldn't make our crossing restriction. His only reply was to contact ZLA. I returned to 118.55 and told ZLA that departure wasn't interested and once again told her we were unable to make the restriction. Her only reply was, 'ok.' at this time, we were at around 17 DME and 12000'. After the turn to daggett the controller informed us to call for possible violation. I asked why I wasn't given a 360 degree turn or vector if there was a conflict. She said the problem was with ont departure. I told here I contacted them as instructed and they weren't interested and returned us to her. She then expressed surprise that I spoke to them. Contributing factor: a temperature inversion of over 10 degrees tat on climb out.

Title: ACR X UNDERSHOT ALT CROSSING RESTRICTION. SITUATION: LGT TYPE ACFT UNABLE TO COMPLY WITH DOWST CROSSING RESTRICTION DURING HOT WX.
Narrative: ACR X DEP RWY 26R WITH XING RESTRICTION OF 14000' AT 19 DME OF POM 294 DEG R (110.4). HE SAID TO CONTACT ZLA AND TELL THEM. I TOLD HIM THAT ZLA SAID TO CONTACT HIM AND AGAIN SAID WE WOULDN'T MAKE OUR XING RESTRICTION. HIS ONLY REPLY WAS TO CONTACT ZLA. I RETURNED TO 118.55 AND TOLD ZLA THAT DEP WASN'T INTERESTED AND ONCE AGAIN TOLD HER WE WERE UNABLE TO MAKE THE RESTRICTION. HER ONLY REPLY WAS, 'OK.' AT THIS TIME, WE WERE AT AROUND 17 DME AND 12000'. AFTER THE TURN TO DAGGETT THE CTLR INFORMED US TO CALL FOR POSSIBLE VIOLATION. I ASKED WHY I WASN'T GIVEN A 360 DEG TURN OR VECTOR IF THERE WAS A CONFLICT. SHE SAID THE PROB WAS WITH ONT DEP. I TOLD HERE I CONTACTED THEM AS INSTRUCTED AND THEY WEREN'T INTERESTED AND RETURNED US TO HER. SHE THEN EXPRESSED SURPRISE THAT I SPOKE TO THEM. CONTRIBUTING FACTOR: A TEMP INVERSION OF OVER 10 DEGS TAT ON CLBOUT.
