Narrative:

Air carrier X pom 4 departure with a restriction of 14000' at dowst intersection. Due to the weight (184300#) of the aircraft, we were unable to meet the 14000' crossing altitude at dowst. Controller was advised as we passed pom VOR 19 mi from dowst. The controller acknowledged but offered no alternative plan or advice. Called again and advised him that we could cross at 12000' he replied with 'continue climb.' after passing dowst at 11800' we were advised of an altitude crossing violation. I overestimated the aircraft performance ability at the gross weight of 183400#. The company manual has no information to refer to re: the performance limits for altitude/distance with temperature and weight factors. The controllers vague reply of 'continue climb' suggested that we were cleared to cross at an altitude less than 14000'. While it is the flight crew's responsibility to ensure they can make the climb, when the crew realizes it cannot make the restriction, they must notify the controller, which the crew did.

Title: ACR X UNDERSHOT ALT CROSSING RESTRICTION. SITUATION: LGT TYPE ACFT UNABLE TO COMPLY WITH DOWST CROSSING RESTRICTION DURING HOT WX.

Narrative: ACR X POM 4 DEP WITH A RESTRICTION OF 14000' AT DOWST INTXN. DUE TO THE WT (184300#) OF THE ACFT, WE WERE UNABLE TO MEET THE 14000' XING ALT AT DOWST. CTLR WAS ADVISED AS WE PASSED POM VOR 19 MI FROM DOWST. THE CTLR ACKNOWLEDGED BUT OFFERED NO ALTERNATIVE PLAN OR ADVICE. CALLED AGAIN AND ADVISED HIM THAT WE COULD CROSS AT 12000' HE REPLIED WITH 'CONTINUE CLB.' AFTER PASSING DOWST AT 11800' WE WERE ADVISED OF AN ALT XING VIOLATION. I OVERESTIMATED THE ACFT PERFORMANCE ABILITY AT THE GROSS WT OF 183400#. THE COMPANY MANUAL HAS NO INFO TO REFER TO RE: THE PERFORMANCE LIMITS FOR ALT/DISTANCE WITH TEMP AND WT FACTORS. THE CTLRS VAGUE REPLY OF 'CONTINUE CLB' SUGGESTED THAT WE WERE CLRED TO CROSS AT AN ALT LESS THAN 14000'. WHILE IT IS THE FLT CREW'S RESPONSIBILITY TO ENSURE THEY CAN MAKE THE CLB, WHEN THE CREW REALIZES IT CANNOT MAKE THE RESTRICTION, THEY MUST NOTIFY THE CTLR, WHICH THE CREW DID.
