Narrative:
I filed an IFR flight with contel duat for YY00Z departure out of hpn. I was coming in from ith with a scheduled departure time of XX00Z. My passenger arrived late at ith and we arrived at hpn at YY45Z. I dropped them off and was ready to depart wo passenger (dead head home). I picked up my clearance and according to my watch was wheels up at XX58Z. This put me up and out within the 2 hours that my clearance is usually held. However, when I offered ny departure direct to my first departure fix (after I had made the initial contact) I was informed that while he still had my strip the computer had thrown out my flight plan. He informed me that he would refile my flight plan as he had it before him. The flight proceeded uneventfully. My worry is that I may have unknowingly and inadvertently departed IFR west/O a clearance. My assumption had been that clearance delivery in hpn would take care of my soon to be timing out clearance, and regardless I had departed prior to my expiration time. In future I will be sure to advise clearance delivery of any late departures. Ps: on my initial call to ny departure, I was told that I was in radar contact and to climb to 10000'. It was only when I volunteered direct to my initial fix on my second call that I was told of my clearance problem.
Original NASA ASRS Text
Title: ATX X FLT CREW FAILED TO UPDATE ETD. FLT PLAN TIMED OUT.
Narrative: I FILED AN IFR FLT WITH CONTEL DUAT FOR YY00Z DEP OUT OF HPN. I WAS COMING IN FROM ITH WITH A SCHEDULED DEP TIME OF XX00Z. MY PAX ARRIVED LATE AT ITH AND WE ARRIVED AT HPN AT YY45Z. I DROPPED THEM OFF AND WAS READY TO DEPART WO PAX (DEAD HEAD HOME). I PICKED UP MY CLRNC AND ACCORDING TO MY WATCH WAS WHEELS UP AT XX58Z. THIS PUT ME UP AND OUT WITHIN THE 2 HRS THAT MY CLRNC IS USUALLY HELD. HOWEVER, WHEN I OFFERED NY DEP DIRECT TO MY FIRST DEP FIX (AFTER I HAD MADE THE INITIAL CONTACT) I WAS INFORMED THAT WHILE HE STILL HAD MY STRIP THE COMPUTER HAD THROWN OUT MY FLT PLAN. HE INFORMED ME THAT HE WOULD REFILE MY FLT PLAN AS HE HAD IT BEFORE HIM. THE FLT PROCEEDED UNEVENTFULLY. MY WORRY IS THAT I MAY HAVE UNKNOWINGLY AND INADVERTENTLY DEPARTED IFR W/O A CLRNC. MY ASSUMPTION HAD BEEN THAT CLRNC DELIVERY IN HPN WOULD TAKE CARE OF MY SOON TO BE TIMING OUT CLRNC, AND REGARDLESS I HAD DEPARTED PRIOR TO MY EXPIRATION TIME. IN FUTURE I WILL BE SURE TO ADVISE CLRNC DELIVERY OF ANY LATE DEPS. PS: ON MY INITIAL CALL TO NY DEP, I WAS TOLD THAT I WAS IN RADAR CONTACT AND TO CLB TO 10000'. IT WAS ONLY WHEN I VOLUNTEERED DIRECT TO MY INITIAL FIX ON MY SECOND CALL THAT I WAS TOLD OF MY CLRNC PROB.
