Narrative:
Early morning departure from ont (the 4TH day of a 4 day trip). Slept very poorly for last 2 nights. Received a xa:45 am local wakeup call with a scheduled xc:30 takeoff. Preflight, taxi, takeoff normal (scheduled departure with 92 passenger) on before start checklist is 'departure briefing'. The first officer and I talked about the pomona four departure, noting the climb restrictions. Our company just completely changed out checklists and moved the departure briefing from the final item back to the before start (6/thu/90). Experienced a flow control delay of approximately 20 min at the end of the runway. First officer, PF, I asked him if he was up to speed on the departure restrictions. He replied yes. Proceeded to takeoff and climbed through the pom 8000' restriction. ATC called us on it at approximately 2 miles southeast VOR going through 9900'. From the time we discussed the departure to implementing it was approximately 40 min. Cause: early morning, new checklist, tired, relied on first officer, head up ass. Supplemental information from acn 155568. First officer incorrectly presuming initial ATC climb clearance to 17000' from ground clearance was unrestricted. Callback conversation with reporter revealed the following: participated in the boeing study. First officer made comment reference the rushed departure and the fact he was much less experienced than the captain and really needed more time to prepare. Captain assumed he was familiar and ready to go.

Narrative: EARLY MORNING DEP FROM ONT (THE 4TH DAY OF A 4 DAY TRIP). SLEPT VERY POORLY FOR LAST 2 NIGHTS. RECEIVED A XA:45 AM LCL WAKEUP CALL WITH A SCHEDULED XC:30 TKOF.
