Narrative:
Departed fll on runway 9L on runway heading to 3000'. Frequency change to mia departure (126.05). New clearance, left turn to heading 280 degree climb to 13000'. I read back clearance, both heading and altitude (company procedure) and then set heading bug on HSI and set 13000' on altitude alerter. Out of 12000' I made 1000' call out. Out of about 12400' controller told us we were only cleared to 10000'. First officer immediately leveled off. I asked controller why he did not catch their error on my readback. His response was, maintain 12000' and a new frequency. There is no doubt in both of our minds that the altitude clearance was 13000'. Where was the controller on my readback, where was he when we were climbing through 10000' and 11000'. I don't know what caused this error, but I do know its hell to live and work in a police state atmosphere.

Title: ACFT CLIMBED ABOVE ASSIGNED ALT DUE TO READBACK HEARBACK PROBLEM.
Narrative: DEPARTED FLL ON RWY 9L ON RWY HDG TO 3000'. FREQ CHANGE TO MIA DEP (126.05). NEW CLRNC, L TURN TO HDG 280 DEG CLB TO 13000'. I READ BACK CLRNC, BOTH HDG AND ALT (COMPANY PROC) AND THEN SET HDG BUG ON HSI AND SET 13000' ON ALT ALERTER. OUT OF 12000' I MADE 1000' CALL OUT. OUT OF ABOUT 12400' CTLR TOLD US WE WERE ONLY CLRED TO 10000'. F/O IMMEDIATELY LEVELED OFF. I ASKED CTLR WHY HE DID NOT CATCH THEIR ERROR ON MY READBACK. HIS RESPONSE WAS, MAINTAIN 12000' AND A NEW FREQ. THERE IS NO DOUBT IN BOTH OF OUR MINDS THAT THE ALT CLRNC WAS 13000'. WHERE WAS THE CTLR ON MY READBACK, WHERE WAS HE WHEN WE WERE CLBING THROUGH 10000' AND 11000'. I DON'T KNOW WHAT CAUSED THIS ERROR, BUT I DO KNOW ITS HELL TO LIVE AND WORK IN A POLICE STATE ATMOSPHERE.
