Narrative:
Departure from mco to iad. The assigned heading was 300 degrees. Just crossing J53 approximately 80 mi south of craig VOR, ZJX controling. Climbing through 12500' to assigned altitude of 13000', an MTR was spotted out of left front window at a close range. Evasive action was initiated and the climb was stopped, and a descent initiated until the MTR passed overhead, then climbed to assigned altitude of 13000'. The controller was notified of the evasive action and told about the MTR; however, he said the MTR was climbing through 14000'. We asked for current altimeter and they were set properly. It was then determined that the MTR was a flight of 2. The lead MTR had the transponder readout, and the second was supposed to be in standard formation. It appeared that in fact the second MTR was approximately 1000' below the lead. If in a formation flight of 2 and the second aircraft is unable to keep in formation during a climb, ATC should have been advised to block out airspace, or possibly second aircraft should have altitude reporting on.

Title: FLT CREW OF MLG IN CLIMB HAD CONFLICT WITH MTR.
Narrative: DEP FROM MCO TO IAD. THE ASSIGNED HDG WAS 300 DEGS. JUST XING J53 APPROX 80 MI S OF CRAIG VOR, ZJX CTLING. CLBING THROUGH 12500' TO ASSIGNED ALT OF 13000', AN MTR WAS SPOTTED OUT OF LEFT FRONT WINDOW AT A CLOSE RANGE. EVASIVE ACTION WAS INITIATED AND THE CLB WAS STOPPED, AND A DSNT INITIATED UNTIL THE MTR PASSED OVERHEAD, THEN CLBED TO ASSIGNED ALT OF 13000'. THE CTLR WAS NOTIFIED OF THE EVASIVE ACTION AND TOLD ABOUT THE MTR; HOWEVER, HE SAID THE MTR WAS CLBING THROUGH 14000'. WE ASKED FOR CURRENT ALTIMETER AND THEY WERE SET PROPERLY. IT WAS THEN DETERMINED THAT THE MTR WAS A FLT OF 2. THE LEAD MTR HAD THE XPONDER READOUT, AND THE SECOND WAS SUPPOSED TO BE IN STANDARD FORMATION.
