Narrative:
According to the FAA we violated P67. There was no mention in any fdc NOTAMS that we checked that P67 had been expanded. According to the new york sectional P67 is only active to 1000 ft AGL. Since we were at 2500 ft we felt we were well above P67. After being notified by the chief pilot that the FAA had notified him of the alleged violation, we double checked all charts, including NOTAMS in the commercial chart and computer that we as pilots have access to and there is no mention of the expansion. Later that morning while flying the same route we called bdr FSS to ask them about P67. The FSS told us that P67 was active to 1000 ft. Only after we asked him to double check his information did he find that P67 had been expanded to 3000 ft AGL and 4 NM either side of the 8 DME fix of the ene VOR radial 142 degree. If this area was expanded we feel as a crew the FAA is lax in making sure this information was available to us as pilots. We are including in our report copies of the NOTAMS available to us through our company computer. Also if the same incident occurred not 12 hours before why were there no company bulletins or notations on our release that this area had been expanded. We were dispatched VFR and feel we were legal in all respects of our flight.
Original NASA ASRS Text
Title: COMMUTER ACCUSED OF VIOLATING PROHIBITED AREA. CANNOT GET PROPER NOTAM INFO.
Narrative: ACCORDING TO THE FAA WE VIOLATED P67. THERE WAS NO MENTION IN ANY FDC NOTAMS THAT WE CHKED THAT P67 HAD BEEN EXPANDED. ACCORDING TO THE NEW YORK SECTIONAL P67 IS ONLY ACTIVE TO 1000 FT AGL. SINCE WE WERE AT 2500 FT WE FELT WE WERE WELL ABOVE P67. AFTER BEING NOTIFIED BY THE CHIEF PLT THAT THE FAA HAD NOTIFIED HIM OF THE ALLEGED VIOLATION, WE DOUBLE CHKED ALL CHARTS, INCLUDING NOTAMS IN THE COMMERCIAL CHART AND COMPUTER THAT WE AS PLTS HAVE ACCESS TO AND THERE IS NO MENTION OF THE EXPANSION. LATER THAT MORNING WHILE FLYING THE SAME RTE WE CALLED BDR FSS TO ASK THEM ABOUT P67. THE FSS TOLD US THAT P67 WAS ACTIVE TO 1000 FT. ONLY AFTER WE ASKED HIM TO DOUBLE CHK HIS INFO DID HE FIND THAT P67 HAD BEEN EXPANDED TO 3000 FT AGL AND 4 NM EITHER SIDE OF THE 8 DME FIX OF THE ENE VOR RADIAL 142 DEG. IF THIS AREA WAS EXPANDED WE FEEL AS A CREW THE FAA IS LAX IN MAKING SURE THIS INFO WAS AVAILABLE TO US AS PLTS. WE ARE INCLUDING IN OUR RPT COPIES OF THE NOTAMS AVAILABLE TO US THROUGH OUR COMPANY COMPUTER. ALSO IF THE SAME INCIDENT OCCURRED NOT 12 HRS BEFORE WHY WERE THERE NO COMPANY BULLETINS OR NOTATIONS ON OUR RELEASE THAT THIS AREA HAD BEEN EXPANDED. WE WERE DISPATCHED VFR AND FEEL WE WERE LEGAL IN ALL RESPECTS OF OUR FLT.
