Narrative:
We were at 5000 ft going into pud. We asked the controller if there was traffic at our 12 O'clock position and he said it was VFR at our 12 O'clock position and 3 mi. We started to look for it and the TCASII issued a yellow TA. Right after that in 2 seconds or less it issued a RA to climb at 1500 FPM above the traffic. I told the controller that we were climbing because of the alert. He said we were to maintain 5000 ft. I said we were climbing anyway because of the TCASII. We climbed to 5800 ft and then descended back to 5000 ft after the conflict. Everything else was normal supplemental information from acn 191840. Approach control was very busy and therefore we felt we did not get a timely descent to 3000 ft to begin approach. We got a TA about 600 ft below us. Coming toward us. I climbed immediately and turned slightly right. Approach said not to.

Title: ACR MLG ALT DEV EXCURSION FROM CLRNC ALT IN RESPONSE TO TCASII RA.
Narrative: WE WERE AT 5000 FT GOING INTO PUD. WE ASKED THE CTLR IF THERE WAS TFC AT OUR 12 O'CLOCK POS AND HE SAID IT WAS VFR AT OUR 12 O'CLOCK POS AND 3 MI. WE STARTED TO LOOK FOR IT AND THE TCASII ISSUED A YELLOW TA. RIGHT AFTER THAT IN 2 SECONDS OR LESS IT ISSUED A RA TO CLB AT 1500 FPM ABOVE THE TFC. I TOLD THE CTLR THAT WE WERE CLBING BECAUSE OF THE ALERT. HE SAID WE WERE TO MAINTAIN 5000 FT. I SAID WE WERE CLBING ANYWAY BECAUSE OF THE TCASII. WE CLBED TO 5800 FT AND THEN DSNDED BACK TO 5000 FT AFTER THE CONFLICT. EVERYTHING ELSE WAS NORMAL SUPPLEMENTAL INFO FROM ACN 191840. APCH CTL WAS VERY BUSY AND THEREFORE WE FELT WE DID NOT GET A TIMELY DSCNT TO 3000 FT TO BEGIN APCH. WE GOT A TA ABOUT 600 FT BELOW US. COMING TOWARD US. I CLBED IMMEDIATELY AND TURNED SLIGHTLY R. APCH SAID NOT TO.
