Narrative:

On nov/mon/91 pilot departed runway 9 at key west international airport at XX45 pm local time. During taxi pilot advised ground that he would be flying along the florida keys to ft lauderdale executive airport. (Key west tower and the naval air station at key west coordinate all arrs and departures). Both ground and tower advised pilot to make a right turnout after takeoff. After takeoff, at end of runway, pilot turned right (sbound) and was given local traffic location. Key west tower instructs pilot to contact navy tower (departure) on 124.45 and advised navy 'with you climbing through 1500'. Navy gives pilot squawk code XXXX and identify instructions, pilot complies. After reaching point 5 mi south of naval air station pilot turns northeast to proceed on his prior declared course along keys to fxe. Navy controller responds negative mode C and requests position, pilot responds 5 mi south of navy air station. Controller then states pilot has 'violated' his 'airspace' without 'permission' and requests call numbers and home base of plane. Pilot so advises. Controller never gives any further instructions to pilot, shortly thereafter radar service is cancelled. Pilot believes he did not violate 'navy' airspace and was in proper contact with navy at all times. Somehow, coordination between key west tower and navy departure concerning pilot's departure broke down. Navy was unable to locate and make initial radar identify of pilot and my location. Pilot has made same departure from key west on numerous occasions over period of yrs. This was the first time any such 'airspace' problem or 'communication' problems occurred. Navy controller responded as though pilot just 'dropped out of the sky' into his 'airspace' as opposed to a standard key west departure along florida keys! Better communication between key west tower and navy departure reference departures from key west would avoid this problem in the future.

NAVY GIVES PLT SQUAWK CODE XXXX AND IDENT INSTRUCTIONS, PLT COMPLIES. AFTER REACHING POINT 5 MI S OF NAVAL AIR STATION PLT TURNS NE TO PROCEED ON HIS PRIOR DECLARED COURSE ALONG KEYS TO FXE. NAVY CTLR RESPONDS NEGATIVE MODE C AND REQUESTS POS, PLT RESPONDS 5 MI S OF NAVY AIR STATION. CTLR THEN STATES PLT HAS 'VIOLATED' HIS 'AIRSPACE' WITHOUT 'PERMISSION' AND REQUESTS CALL NUMBERS AND HOME BASE OF PLANE. PLT SO ADVISES. SOMEHOW, COORD BTWN KEY W TWR AND NAVY DEP CONCERNING PLT'S DEP BROKE DOWN. NAVY WAS UNABLE TO LOCATE AND MAKE INITIAL RADAR IDENT OF PLT AND MY LOCATION. PLT HAS MADE SAME DEP FROM KEY W ON NUMEROUS OCCASIONS OVER PERIOD OF YRS. THIS WAS THE FIRST TIME ANY SUCH 'AIRSPACE' PROBLEM OR 'COM' PROBLEMS OCCURRED. NAVY CTLR RESPONDED AS THOUGH PLT JUST 'DROPPED OUT OF THE SKY' INTO HIS 'AIRSPACE' AS OPPOSED TO A STANDARD KEY W DEP ALONG FLORIDA KEYS! BETTER COM BTWN KEY W TWR AND NAVY DEP REF DEPS FROM KEY W WOULD AVOID THIS PROBLEM IN THE FUTURE.
