Narrative:
Climbing to interim altitude of 12000 MSL in compliance with musels/thermal transition from sna. Recognized a TA from TCASII at 10 O'clock, 500 below and climbing greater than our climb rate (now less than 1000 FPM) and seemingly converging. Captain queried ATC preemptively of this traffic and was assured that he had us in sight -- not possible. Intruding aircraft showed 'too' on TCASII and since we neared (within 200 ft, 12000 ft MSL) with holes becoming visible in cloud layer indicating that the tops were near, I elected to continue climb to be assured of visually identing and then separating myself from conflicting traffic. I leveled at 12400 briefly, now noting descent of intruder whereby I descended to assigned altitude. Captain continued to discuss incident with ZLA explaining nature of altitude excursion. Both captain and center controller seemed to feel that the situation was resolved satisfactorily.
Original NASA ASRS Text
Title: ACR IN CLB HAS TCASII RA. CONTINUES CLB BEYOND ASSIGNED ALT.
Narrative: CLBING TO INTERIM ALT OF 12000 MSL IN COMPLIANCE WITH MUSELS/THERMAL TRANSITION FROM SNA. RECOGNIZED A TA FROM TCASII AT 10 O'CLOCK, 500 BELOW AND CLBING GREATER THAN OUR CLB RATE (NOW LESS THAN 1000 FPM) AND SEEMINGLY CONVERGING. CAPT QUERIED ATC PREEMPTIVELY OF THIS TFC AND WAS ASSURED THAT HE HAD US IN SIGHT -- NOT POSSIBLE. INTRUDING ACFT SHOWED 'TOO' ON TCASII AND SINCE WE NEARED (WITHIN 200 FT, 12000 FT MSL) WITH HOLES BECOMING VISIBLE IN CLOUD LAYER INDICATING THAT THE TOPS WERE NEAR, I ELECTED TO CONTINUE CLB TO BE ASSURED OF VISUALLY IDENTING AND THEN SEPARATING MYSELF FROM CONFLICTING TFC. I LEVELED AT 12400 BRIEFLY, NOW NOTING DSCNT OF INTRUDER WHEREBY I DSNDED TO ASSIGNED ALT. CAPT CONTINUED TO DISCUSS INCIDENT WITH ZLA EXPLAINING NATURE OF ALT EXCURSION. BOTH CAPT AND CTR CTLR SEEMED TO FEEL THAT THE SITUATION WAS RESOLVED SATISFACTORILY.
