Narrative:
Flight from ktix to KC19. A line of thunderstorms with hail developed on an e-w line from fl, panhandle to area north of jacksonville. Thunderstorms moved across J53. Requested and received clearance to deviate east of course, but not east of the omn 360 degree radial at 70 NM. Further deviation east (5 degree) required to avoid highest level thunderstorms (they totally attenuated the radar and were later reported to contain grapefruit-size hail). Center frequency was jax 126.35. Just prior to frequency change, center asked if we knew that we had exceeded our clearance limit by '14 mi into the military warning area.' I responded that the deviation was required to ensure safety of flight. Both CDI's showed us on the 004 degree radial of omn at the time of the controller's statement. In my opinion, flying any further west would have been a careless and reckless operation, possibly endangering the aircraft, passenger, and crew.

Title: HDG TRACK DEV IN NON ADHERENCE TO ATC CLRNC CREATES AN UNAUTHORIZED PENETRATION OF AIRSPACE. PROX OF MOA.
Narrative: FLT FROM KTIX TO KC19. A LINE OF TSTMS WITH HAIL DEVELOPED ON AN E-W LINE FROM FL, PANHANDLE TO AREA N OF JACKSONVILLE. TSTMS MOVED ACROSS J53. REQUESTED AND RECEIVED CLRNC TO DEVIATE E OF COURSE, BUT NOT E OF THE OMN 360 DEG RADIAL AT 70 NM. FURTHER DEV E (5 DEG) REQUIRED TO AVOID HIGHEST LEVEL TSTMS (THEY TOTALLY ATTENUATED THE RADAR AND WERE LATER RPTED TO CONTAIN GRAPEFRUIT-SIZE HAIL). CTR FREQ WAS JAX 126.35. JUST PRIOR TO FREQ CHANGE, CTR ASKED IF WE KNEW THAT WE HAD EXCEEDED OUR CLRNC LIMIT BY '14 MI INTO THE MIL WARNING AREA.' I RESPONDED THAT THE DEV WAS REQUIRED TO ENSURE SAFETY OF FLT. BOTH CDI'S SHOWED US ON THE 004 DEG RADIAL OF OMN AT THE TIME OF THE CTLR'S STATEMENT. IN MY OPINION, FLYING ANY FURTHER W WOULD HAVE BEEN A CARELESS AND RECKLESS OP, POSSIBLY ENDANGERING THE ACFT, PAX, AND CREW.
