Narrative:

Inadvertent altitude deviation and speed deviation caused by improper programming of FMC on the ground during setup. Controller instructions to maintain 5000 ft, but instructions were not clear to me and my copilot. Extremely saturated departure control frequency kept us from getting a clarification of clearance for approximately 1 min. During this time, aircraft climbed to 5400 ft and speed advanced to 265 KTS. Before descent could be made, we finally were able to contact controller who cleared us to continue our climb and speed was reduced immediately.

Title: ACR CLBS ABOVE ASSIGNED ALT AND EXCEEDS SPD RESTRICTION ON INITIAL CLB.

Narrative: INADVERTENT ALTDEV AND SPD DEV CAUSED BY IMPROPER PROGRAMMING OF FMC ON THE GND DURING SETUP. CTLR INSTRUCTIONS TO MAINTAIN 5000 FT, BUT INSTRUCTIONS WERE NOT CLR TO ME AND MY COPLT. BEFORE DSCNT COULD BE MADE, WE FINALLY WERE ABLE TO CONTACT CTLR WHO CLRED US TO CONTINUE OUR CLB AND SPD WAS REDUCED IMMEDIATELY.
