Narrative:

We were en route from lfpo to kmia. After passing 40N 30W, we noticed an aircraft ahead at FL350 at about 5 mi on TCASII. We noticed the aircraft start a climb from 350 and level at FL370. We called santa maria radio and inquired to this. They selcaled the other aircraft asked his 38N 40W estimate, then called us back and climbed us to FL390. Flight continued to mia. Supplemental information from acn 229743: during a transatlantic crossing from lhr to mia, santa maria radio cleared us to climb from FL350 to FL370. This resulted in us being ahead of another aircraft on the same route and same altitude with inadequate separation.

THIS RESULTED IN US BEING AHEAD OF ANOTHER ACFT ON THE SAME RTE AND SAME ALT WITH INADEQUATE SEPARATION.
