Narrative:

I was the radar controller in charge. I received the radar position. The previous controller advised me of the conflict between air carrier X and air carrier Y. Air carrier X had been assigned FL350 by previous controller. Air carrier Y was wbound at FL310. I advised the controller that I was relieving that I would stop air carrier X at FL280 for the traffic. I issued the clearance to air carrier X to maintain FL280. Air carrier X did not acknowledge and I must have been distracted. I did not catch the missed readback when I noticed air carrier X above the assigned altitude, I advised air carrier X to maintain FL290. Air carrier X acknowledged, the mode C then showed FL297. I asked air carrier X to say altitude. Air carrier X advised level at FL290. Air carrier Y, which was TCASII equipped, did not advise of an RA.

Narrative: I WAS THE RADAR CTLR IN CHARGE. I RECEIVED THE RADAR POS. THE PREVIOUS CTLR ADVISED ME OF THE CONFLICT BTWN ACR X AND ACR Y. ACR X HAD BEEN ASSIGNED FL350 BY PREVIOUS CTLR. ACR Y WAS WBOUND AT FL310. I ADVISED THE CTLR THAT I WAS RELIEVING THAT I WOULD STOP ACR X AT FL280 FOR THE TFC. I ISSUED THE CLRNC TO ACR X TO MAINTAIN FL280. ACR X DID NOT ACKNOWLEDGE AND I MUST HAVE BEEN DISTRACTED. I DID NOT CATCH THE MISSED READBACK WHEN I NOTICED ACR X ABOVE THE ASSIGNED ALT, I ADVISED ACR X TO MAINTAIN FL290. ACR X ACKNOWLEDGED, THE MODE C THEN SHOWED FL297. I ASKED ACR X TO SAY ALT. ACR X ADVISED LEVEL AT FL290. ACR Y, WHICH WAS TCASII EQUIPPED, DID NOT ADVISE OF AN RA.
