Narrative:
17 mi northwest of sjc VOR en route to slc, departure advised of traffic 12 O'clock and climbing to 12000 ft MSL. We were at 13000 ft. TCASII picked up traffic and gave TA, followed by an RA commanding 2000 FPM climb. We initiated climb and advised departure. He replied that traffic was restr 1000 ft below us. My reply was that's fine, but I cannot ignore an RA. Maybe a shallower level off by climbing aircraft would prevent this from happening.

Title: TCASII RA FORCES MLG TO CLB 700 FT ABOVE ASSIGNED ALT.
Narrative: 17 MI NW OF SJC VOR ENRTE TO SLC, DEP ADVISED OF TFC 12 O'CLOCK AND CLBING TO 12000 FT MSL. WE WERE AT 13000 FT. TCASII PICKED UP TFC AND GAVE TA, FOLLOWED BY AN RA COMMANDING 2000 FPM CLB. WE INITIATED CLB AND ADVISED DEP. HE REPLIED THAT TFC WAS RESTR 1000 FT BELOW US. MY REPLY WAS THAT'S FINE, BUT I CANNOT IGNORE AN RA. MAYBE A SHALLOWER LEVEL OFF BY CLBING ACFT WOULD PREVENT THIS FROM HAPPENING.
