Narrative:
ATC cleared us to 4000 ft MSL. We acknowledged. While in climb were given traffic at 7000 ft (light transport). While looking for the traffic and working on fixing a malfunctioning communication radio, we ascended 500 ft above our clearance limit and upon noticing we immediately started a descent. Callback conversation with reporter revealed the following information: reporter stated there was another pilot in the right seat working the radio's but no instruction was taking place. Reporter stated initial clearance was to 3000 ft. When the pilot working radio changed to departure control, communication 1 radio was blaring and communication 2 was selected. While trying to correct communication 1 problem altitude deviation occurred. Reporter stated to the best of his knowledge there was no conflict with any other aircraft. FAA has asked for a response because of the altitude deviation.

Title: SMT X NON ADHERENCE TO ATC CLRNC CLB THROUGH ASSIGNED ALT. PLTDEV.
Narrative: ATC CLRED US TO 4000 FT MSL. WE ACKNOWLEDGED. WHILE IN CLB WERE GIVEN TFC AT 7000 FT (LTT). WHILE LOOKING FOR THE TFC AND WORKING ON FIXING A MALFUNCTIONING COM RADIO, WE ASCENDED 500 FT ABOVE OUR CLRNC LIMIT AND UPON NOTICING WE IMMEDIATELY STARTED A DSCNT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED THERE WAS ANOTHER PLT IN THE R SEAT WORKING THE RADIO'S BUT NO INSTRUCTION WAS TAKING PLACE. RPTR STATED INITIAL CLRNC WAS TO 3000 FT. WHEN THE PLT WORKING RADIO CHANGED TO DEP CTL, COM 1 RADIO WAS BLARING AND COM 2 WAS SELECTED. WHILE TRYING TO CORRECT COM 1 PROB ALTDEV OCCURRED. RPTR STATED TO THE BEST OF HIS KNOWLEDGE THERE WAS NO CONFLICT WITH ANY OTHER ACFT. FAA HAS ASKED FOR A RESPONSE BECAUSE OF THE ALTDEV.
