Narrative:

En route via westminster 2 arrival to bwi between mrb and ruane intersection at 11000 ft, small transport Y traffic passed under nose and left wing climbing wbound. I called dulles approach control. Reply, no target, small transport Y. Then called in on same frequency requesting IFR clearance. Approach then replied there's your target. I talked to the captain by phone at a later date to see if he had seen us. The small transport Y crew had seen us and stated there was no time for evasive action. He also stated his transponder was on squawk 1200. They elected to depart fdk VFR because they were unable to receive IFR clearance right away on ground. They had 10 people on board, air conditioning was inoperative.

THEN CALLED IN ON SAME FREQ REQUESTING IFR CLRNC. APCH THEN REPLIED THERE'S YOUR TARGET. I TALKED TO THE CAPT BY PHONE AT A LATER DATE TO SEE IF HE HAD SEEN US. THE SMT Y CREW HAD SEEN US AND STATED THERE WAS NO TIME FOR EVASIVE ACTION. HE ALSO STATED HIS XPONDER WAS ON SQUAWK 1200. THEY ELECTED TO DEPART FDK VFR BECAUSE THEY WERE UNABLE TO RECEIVE IFR CLRNC RIGHT AWAY ON GND. THEY HAD 10 PEOPLE ON BOARD, AIR CONDITIONING WAS INOPERATIVE.
