Narrative:
Small aircraft X northbound V-3 at 7000 working jax approach on 118.0. Jax approach had stated he was not receiving my 'mode C' -- I acknowledged. Next saw military Y climbing southeast towards me. As it appeared a collision was possible, I dropped 300 ft to 6700 -- military Y passed above and slightly behind me. Returned to 7000 and continued flight. On call back to controller, was told military Y had been cleared from 6000 to 8000. Military Y was on UHF, so did not hear his comments, but from ATC talk, realized he had asked also. ATC told military Y he had 'lost' my transponder, etc. He apologized to military Y. Believe ATC forgot about us when he lost the transponder return. On arrival at destination, had transponder and encoder removed and checked! All checked out normal by licensed avionics repair station! (No problem was discovered -- all worked normal on return flight.) supplemental information from acn 244886: no mode C small aircraft X northbound at 7000 ft. Military Y southeast bound at 7000 ft.

Title: MIL Y CLB THROUGH OCCUPIED ALT HAD LTSS FROM SMA X. SYS ERROR.
Narrative: SMA X NBOUND V-3 AT 7000 WORKING JAX APCH ON 118.0. JAX APCH HAD STATED HE WAS NOT RECEIVING MY 'MODE C' -- I ACKNOWLEDGED. NEXT SAW MIL Y CLBING SE TOWARDS ME. AS IT APPEARED A COLLISION WAS POSSIBLE, I DROPPED 300 FT TO 6700 -- MIL Y PASSED ABOVE AND SLIGHTLY BEHIND ME. RETURNED TO 7000 AND CONTINUED FLT. ON CALL BACK TO CTLR, WAS TOLD MIL Y HAD BEEN CLRED FROM 6000 TO 8000. MIL Y WAS ON UHF, SO DID NOT HEAR HIS COMMENTS, BUT FROM ATC TALK, REALIZED HE HAD ASKED ALSO. ATC TOLD MIL Y HE HAD 'LOST' MY XPONDER, ETC. HE APOLOGIZED TO MIL Y. BELIEVE ATC FORGOT ABOUT US WHEN HE LOST THE XPONDER RETURN. ON ARR AT DEST, HAD XPONDER AND ENCODER REMOVED AND CHKED!
