Narrative:
Flight bur-oak filed van nuys 7 departure. Took off and turned to a 210 degree heading. We were told to climb to 3000 ft on a 210 degree heading. Switched over to departure control and then was instructed to turn to a 240 degree and 4000 ft altitude. The controller was clearly overloaded. The visibility was 3 mi in haze. He then instructed us to climb to 13000 ft on a 320 degree heading. We then saw a target on TCASII at 5 mi range at approximately 4700 ft at 12 O'clock position. I told the controller that I had to maintain 4700 ft and I received an RA to descend. The aircraft was an small aircraft sel that passed 300 ft over the top of us. I believe that TCASII saved us from a midair. We were not told of the 12 O'clock traffic!

Title: CAPT OF AN MLG ACR ACFT STOPPED CLBING TO TAKE EVASIVE ACTION IN RESPONSE TO A TCASII RA AND SUBSEQUENT SIGHTING OF THE OTHER ACFT WHICH RESULTED IN A NMAC.
Narrative: FLT BUR-OAK FILED VAN NUYS 7 DEP. TOOK OFF AND TURNED TO A 210 DEG HDG. WE WERE TOLD TO CLB TO 3000 FT ON A 210 DEG HDG. SWITCHED OVER TO DEP CTL AND THEN WAS INSTRUCTED TO TURN TO A 240 DEG AND 4000 FT ALT. THE CTLR WAS CLRLY OVERLOADED. THE VISIBILITY WAS 3 MI IN HAZE. HE THEN INSTRUCTED US TO CLB TO 13000 FT ON A 320 DEG HDG. WE THEN SAW A TARGET ON TCASII AT 5 MI RANGE AT APPROX 4700 FT AT 12 O'CLOCK POS. I TOLD THE CTLR THAT I HAD TO MAINTAIN 4700 FT AND I RECEIVED AN RA TO DSND. THE ACFT WAS AN SMA SEL THAT PASSED 300 FT OVER THE TOP OF US. I BELIEVE THAT TCASII SAVED US FROM A MIDAIR. WE WERE NOT TOLD OF THE 12 O'CLOCK TFC!
