Narrative:
On the airway in new york oceanic airspace we requested either a climb to FL370 or a deviation west of course. When we heard nothing in 10 or 15 mins, I called commercial radio again and advised them I was 'exercising captain's emergency authority' and 'deviating west.' commercial radio then selcaled me and said 'new york oceanic advises that you compromised lateral separation between my airway, A523, and amber 300. I guess they need 90 mi separation. 'I would rather get violated for going around a thunderstorm than going through it!' this busy oceanic non radar airspace using high frequency relay through commercial radio is not efficient. It needs to use satcom directly to new york oceanic reflecting the technology available, not yesterday's nostalgic airway navigation and communication.

Title: CAPT OF AN LGT ACR ACFT DEVIATED FROM ASSIGNED COURSE TO AVOID WX DURING CRUISE OVER AN OCEANIC RTE.
Narrative: ON THE AIRWAY IN NEW YORK OCEANIC AIRSPACE WE REQUESTED EITHER A CLB TO FL370 OR A DEV W OF COURSE. WHEN WE HEARD NOTHING IN 10 OR 15 MINS, I CALLED COMMERCIAL RADIO AGAIN AND ADVISED THEM I WAS 'EXERCISING CAPT'S EMER AUTHORITY' AND 'DEVIATING W.' 'I WOULD RATHER GET VIOLATED FOR GOING AROUND A TSTM THAN GOING THROUGH IT!' THIS BUSY OCEANIC NON RADAR AIRSPACE USING HIGH FREQ RELAY THROUGH COMMERCIAL RADIO IS NOT EFFICIENT. IT NEEDS TO USE SATCOM DIRECTLY TO NEW YORK OCEANIC REFLECTING THE TECHNOLOGY AVAILABLE, NOT YESTERDAY'S NOSTALGIC AIRWAY NAV AND COM.
