Narrative:

Small transport X en route wbound at 6500 MSL. Air carrier Y descending opposite direction to 7000 ft MSL. Traffic issued to both aircraft. Air carrier Y leveled at 7500 ft until passing small transport X, even though air carrier Y had reported small transport X in sight. This is another example of how TCASII erodes the controller's ability to separate VFR and IFR traffic. It also causes the pilots to be continuously second-guessing the controller and adds to frequency congestion. Company regulations are too restrictive in the mandatory compliance of RA's.

Title: ACR Y TCASII RA WITH VFR SMT X NON ADHERENCE TO ATC CLRNC. EVASIVE ACTION TAKEN. SEE AND AVOID CONCEPT.

Narrative: SMT X ENRTE WBOUND AT 6500 MSL. ACR Y DSNDING OPPOSITE DIRECTION TO 7000 FT MSL. TFC ISSUED TO BOTH ACFT. ACR Y LEVELED AT 7500 FT UNTIL PASSING SMT X, EVEN THOUGH ACR Y HAD RPTED SMT X IN SIGHT. THIS IS ANOTHER EXAMPLE OF HOW TCASII ERODES THE CTLR'S ABILITY TO SEPARATE VFR AND IFR TFC. IT ALSO CAUSES THE PLTS TO BE CONTINUOUSLY SECOND-GUESSING THE CTLR AND ADDS TO FREQ CONGESTION. COMPANY REGS ARE TOO RESTRICTIVE IN THE MANDATORY COMPLIANCE OF RA'S.
