Narrative:
Received IFR clearance from oak to bfl, including climb and maintain 10000, expect FL290 10 mins after departure (no mention was made of observing climb restriction). After takeoff during climb was told by controller that we had exceeded restriction at 4 NM of oak below 2000. I was under the impression that when cleared to an altitude without restrictions mentioned, that uninterrupted climb was allowed. It is still unclr to me after checking airman's information manual if climb restrictions apply using a SID. The aim gives me the impression climb restrictions must be listed in clearance or they do not apply.
Original NASA ASRS Text
Title: A CPR SMT FAILED TO COMPLY WITH SID RESTRICTIONS.
Narrative: RECEIVED IFR CLRNC FROM OAK TO BFL, INCLUDING CLB AND MAINTAIN 10000, EXPECT FL290 10 MINS AFTER DEP (NO MENTION WAS MADE OF OBSERVING CLB RESTRICTION). AFTER TKOF DURING CLB WAS TOLD BY CTLR THAT WE HAD EXCEEDED RESTRICTION AT 4 NM OF OAK BELOW 2000. I WAS UNDER THE IMPRESSION THAT WHEN CLRED TO AN ALT WITHOUT RESTRICTIONS MENTIONED, THAT UNINTERRUPTED CLB WAS ALLOWED. IT IS STILL UNCLR TO ME AFTER CHKING AIRMAN'S INFO MANUAL IF CLB RESTRICTIONS APPLY USING A SID. THE AIM GIVES ME THE IMPRESSION CLB RESTRICTIONS MUST BE LISTED IN CLRNC OR THEY DO NOT APPLY.
