Narrative:
Approximately 35 NM north of baltimore VOR and level at 6000 ft, we received a TCASII advisory followed shortly thereafter by a TCASII RA. The TCASII commanded us to climb and not having a visual on the traffic, I disconnected the autoplt and initiated the climb as per the TCASII instruction. Once established in the climb we acquired visual sighting of the traffic involved and I was able to maintain visual separation. The TCASII RA and climb was then reported to bwi approach control and the aircraft was returned to our previously assigned altitude. Supplemental information from acn 257052: I notified ATC that we received an RA. The controller then stated he would be filing paperwork because we violated minimum separation with the other aircraft.

Title: FLC OF AN MDT ACR ACFT CLBED ABOVE ASSIGNED ALT IN RESPONSE TO A TCASII RA.
Narrative: APPROX 35 NM N OF BALTIMORE VOR AND LEVEL AT 6000 FT, WE RECEIVED A TCASII ADVISORY FOLLOWED SHORTLY THEREAFTER BY A TCASII RA. THE TCASII COMMANDED US TO CLB AND NOT HAVING A VISUAL ON THE TFC, I DISCONNECTED THE AUTOPLT AND INITIATED THE CLB AS PER THE TCASII INSTRUCTION. ONCE ESTABLISHED IN THE CLB WE ACQUIRED VISUAL SIGHTING OF THE TFC INVOLVED AND I WAS ABLE TO MAINTAIN VISUAL SEPARATION. THE TCASII RA AND CLB WAS THEN RPTED TO BWI APCH CTL AND THE ACFT WAS RETURNED TO OUR PREVIOUSLY ASSIGNED ALT. SUPPLEMENTAL INFORMATION FROM ACN 257052: I NOTIFIED ATC THAT WE RECEIVED AN RA. THE CTLR THEN STATED HE WOULD BE FILING PAPERWORK BECAUSE WE VIOLATED MINIMUM SEPARATION WITH THE OTHER ACFT.
