Narrative:

Air carrier X in cruise at assigned FL350, first officer flying. A TA occurs on the TCASII coming onto the scope at 2 O'clock at 6 mi. Within seconds an RA occurs, at about the same time the first officer spots the traffic at our flight level. The captain disconnects autoplt and follows the TCASII RA in a 1500 FPM descent to FL342. First officer contacts ATC, and is advised to turn right by ATC, but, by this time we are well into descent. Air carrier Y also saw us. I do not know if he climbed. When he passed in front of and above us, he was about 5000 ft away. We had been with this controller for 15-20 mins. We had been cleared direct to aspit and this put us to the south of airway UN582. The controller knew we were at the same flight level but his earlier plan showed air carrier Y passing well ahead of us. He must have failed to check this as we got closer.

FO CONTACTS ATC, AND IS ADVISED TO TURN R BY ATC, BUT, BY THIS TIME WE ARE WELL INTO DSCNT. ACR Y ALSO SAW US. I DO NOT KNOW IF HE CLBED. WHEN HE PASSED IN FRONT OF AND ABOVE US, HE WAS ABOUT 5000 FT AWAY. WE HAD BEEN WITH THIS CTLR FOR 15-20 MINS. WE HAD BEEN CLRED DIRECT TO ASPIT AND THIS PUT US TO THE S OF AIRWAY UN582. THE CTLR KNEW WE WERE AT THE SAME FLT LEVEL BUT HIS EARLIER PLAN SHOWED ACR Y PASSING WELL AHEAD OF US. HE MUST HAVE FAILED TO CHK THIS AS WE GOT CLOSER.
