Narrative:

We had been cleared to and were descending to FL240 from FL310. Descending through FL280 TCASII gave a TA at FL270 approximately 10 mi this changed to an RA at the same time center asked if we were descending to FL280. We replied negative, descending to FL240 we made a 90 degree left turn to miss other aircraft. Other aircraft after stated he had us in sight and no real problem existed. We were then cleared to continue to FL240. I talked with oak ARTCC area administrator upon landing and he stated we had been cleared to FL240 and had read back same. He also stated there had been a controller/software error. There was little or no time to respond to the TCASII RA and our evasive action was partially based on the first officer's visual sighting.

Title: FLC OF AN LGT ACFT TOOK EVASIVE ACTION IN RESPONSE TO A TCASII RA AND TURNED OFF ASSIGNED HDG. LTSS.

Narrative: WE HAD BEEN CLRED TO AND WERE DSNDING TO FL240 FROM FL310. DSNDING THROUGH FL280 TCASII GAVE A TA AT FL270 APPROX 10 MI THIS CHANGED TO AN RA AT THE SAME TIME CTR ASKED IF WE WERE DSNDING TO FL280. WE REPLIED NEGATIVE, DSNDING TO FL240 WE MADE A 90 DEG L TURN TO MISS OTHER ACFT. OTHER ACFT AFTER STATED HE HAD US IN SIGHT AND NO REAL PROB EXISTED. WE WERE THEN CLRED TO CONTINUE TO FL240. I TALKED WITH OAK ARTCC AREA ADMINISTRATOR UPON LNDG AND HE STATED WE HAD BEEN CLRED TO FL240 AND HAD READ BACK SAME. HE ALSO STATED THERE HAD BEEN A CTLR/SOFTWARE ERROR. THERE WAS LITTLE OR NO TIME TO RESPOND TO THE TCASII RA AND OUR EVASIVE ACTION WAS PARTIALLY BASED ON THE FO'S VISUAL SIGHTING.
