Narrative:

We were cruising at FL350 from gru to mia. We were cleared vagan intersection direct to maiqueta VOR. First awareness was on TCASII screen, an aircraft at plus 100 ft and 40 mi. As he approached at about 20 NM between us he was dead ahead and plus 200-300 ft. We disconnected autoplt, turned left and descended about 300 ft to 34700 ft. TCASII mode RA: descend 1500 FPM. Aircraft passed about 1 mi starboard at 35500 ft (plus 800 ft). We returned to FL350 and he was still at 35500 ft. We determined from maiqueta center he was air carrier XXX. We had him visually the whole time, due to fact he had his lights on, we turned ours on and off, he did not alter his.

WE HAD HIM VISUALLY THE WHOLE TIME, DUE TO FACT HE HAD HIS LIGHTS ON, WE TURNED OURS ON AND OFF, HE DID NOT ALTER HIS.
