Narrative:
Departed lyh on a maintenance acceptance flight at XY45 am. Crew was to verify that the gear in-transit lights operated properly. Plans were to fly the traffic pattern and verify light operation. While in flight, nose gear in-transit light failed to indicate a positive gear down indication. Proceeded to depart the traffic pattern and remain in the local area to perform associated checklists. Per recommendations from maintenance (via radio), crew recycled landing gear (approximately 5 times) and performed the emergency gear extension checklist, results were not successful. Having 2600 pounds of fuel on board, crew proceeded to burn off excess fuel. Notified lyh tower of our situation and that we would be burning off excess fuel and declaring an emergency for the landing. We requested a fly-by of the tower prior to landing so ATC could provide a report on nose gear position. ATC confirmed gear down. After the fly-by and prior to landing, crew performed the 'nose gear not locked down' checklist. Landing was uneventful. Returned aircraft to maintenance hangar.

Title: FLT TEST ACTIVITY REVEALS THAT ACFT EQUIP PROB STILL EXISTED.

PER RECOMMENDATIONS FROM MAINT (VIA RADIO), CREW RECYCLED LNDG GEAR (APPROX 5 TIMES) AND PERFORMED THE EMER GEAR EXTENSION CHKLIST, RESULTS WERE NOT SUCCESSFUL. HAVING 2600 LBS OF FUEL ON BOARD, CREW PROCEEDED TO BURN OFF EXCESS FUEL. NOTIFIED LYH TWR OF OUR SIT AND THAT WE WOULD BE BURNING OFF EXCESS FUEL AND DECLARING AN EMER FOR THE LNDG.
